Important Notice

These Terms and Conditions set out your legal rights and responsibilities when using the FredConSol platform. Please read them carefully before using the Service.

1 Provider Details

The software platform, applications, and services ("Platform") are provided by Freddies Construction Solutions, operating in the United Kingdom.

2 Definitions

"Platform"

means any software application, web-based system, module, feature, or digital service provided by Freddies Construction Solutions, whether current or future.

"Service"

means the tools, workflows, features, templates, automation, logic, and functionality made available through the Platform.

"User"

means any individual or organisation accessing or using the Platform.

"Content"

means any document, assessment, record, policy, plan, output, data, or material created, edited, exported, stored, or published using the Platform.

"Applicable Law"

includes all relevant UK legislation, regulations, Approved Codes of Practice, and guidance applicable to the User's activities.

3 Nature of the Service

3.1

FredConSol is a construction document management platform providing the following tools:

  • RAMS Creator — guided generation of Risk Assessments and Method Statements
  • Site Diary — daily site record keeping and progress notes
  • Training Matrix — worker qualification and certification tracking
  • COSHH Creator — COSHH assessment generation and management
  • Additional products in development, including Induction Forms, Programmes, and PUWER/LOLER inspection tools

3.2

The Platform does not provide legal advice, health and safety advice, engineering advice, design services, or professional consultancy services.

3.3

Any templates, example wording, suggested content, automated outputs, or system prompts are provided for general guidance only and are not tailored to any specific site, activity, or circumstances unless expressly stated.

4 Subscriptions, Fees, and Access

4.1 Plans and Pricing

Plans, pricing, and document allowances are as listed on the pricing page at the time of purchase. Freddies Construction Solutions reserves the right to update pricing with reasonable notice.

4.2 Document Allowances

RAMS document allowances roll over — unused documents carry forward month to month for the duration of your active subscription.

4.3 Seats

Team seats apply to RAMS Creator only. Site Diary, Training Matrix, and COSHH Creator have no seat limits — all team members can access these features regardless of seat count.

4.4 Cancellation

You may cancel your subscription at any time. Access to the Service will continue until the end of the paid billing period. No partial refunds are issued for the unused portion of a billing period.

4.5 Refunds

No refunds are issued for document allowances already used. If you experience a technical fault that prevents you from using a document allowance you were entitled to, contact us and we will investigate.

4.6 Payment Processing

Payments are processed securely by Stripe. By subscribing, you agree to Stripe's terms of service. We do not store payment card details.

5 User Responsibility and Competence

5.1 You remain solely responsible for:

  • The accuracy and completeness of all documents produced using the Platform
  • Ensuring all Content complies with current regulations before use
  • Verifying AI-generated content against current standards, guidance, and site-specific conditions
  • Ensuring Content is reviewed, approved, and implemented by a competent and suitably qualified person
  • Maintaining appropriate competence to review documents produced using the Platform
  • Informing workers whose personal data is stored in the Training Matrix
  • Verifying COSHH data against current Safety Data Sheets and HSE EH40 Workplace Exposure Limits

5.2

The Platform does not assess competence, verify qualifications, or confirm legal or regulatory compliance.

5.3

Use of the Platform does not create, imply, or evidence competence.

6 Training Matrix — Data Controller Responsibilities

6.1

When using Training Matrix, you act as the Data Controller for worker records stored within the Service. FredConSol acts as your Data Processor.

6.2

You must have a lawful basis for storing worker personal data under UK GDPR. Legitimate Interest under employers' legal obligations (CDM Regulations 2015, PUWER 1998, LOLER 1998) is typically applicable.

6.3

FredConSol is not responsible for the accuracy of qualification records entered into the Training Matrix. You are responsible for ensuring records are accurate, current, and maintained.

6.4

You are responsible for responding to data subject access requests from workers whose data is held in the Training Matrix.

7 COSHH Creator

7.1

COSHH assessments generated using the Platform are AI-assisted drafts. They are intended as a starting point only.

7.2 Before using any COSHH assessment you must:

  • Verify all hazard data against the current manufacturer's Safety Data Sheet (SDS)
  • Check all Workplace Exposure Limits (WELs) against current HSE EH40 guidance
  • Confirm that control measures are appropriate for your specific workplace and activity
  • Have the assessment reviewed and approved by a competent person

7.3

FredConSol accepts no liability for COSHH assessments used without verification against current Safety Data Sheets and applicable HSE guidance.

8 Beta Notice

8.1

FredConSol is currently in public beta. During this period:

  • Features may change, be added, or be removed without prior notice
  • We will not delete your data without providing prior notice
  • Pricing during beta may change when moving to full release — we will provide reasonable notice of any changes
  • We make no guarantee of uninterrupted availability during the beta period

8.2

Beta users provide valuable feedback that helps improve the platform. If you encounter issues or have suggestions, please contact us at contact@fredconsol.co.uk.

9 Document-Specific Acknowledgement

9.1

Many documents generated using the Platform are site-specific, task-specific, and time-sensitive.

9.2

Any Content generated using the Platform:

  • May be generic in nature
  • May not reflect actual site conditions, sequencing, environment, workforce behaviour, or unforeseen hazards
  • Must not be used without appropriate review, amendment, and validation

9.3

The Platform does not determine whether any Content is "suitable and sufficient" for the purposes of Applicable Law.

10 No Reliance

10.1

The Platform must not be relied upon as a substitute for:

  • Professional advice
  • Site-specific risk assessment
  • Statutory inspections, examinations, or certifications

10.2

Any reliance placed on Content generated using the Platform is entirely at the User's own risk.

11 Dynamic Risk and Ongoing Review

11.1

Construction environments are dynamic and subject to change.

11.2

The Platform does not:

  • Monitor live site conditions
  • Identify emerging hazards
  • Automatically update Content in response to change

11.3

The User remains solely responsible for:

  • Dynamic risk assessment
  • Ongoing review of documentation
  • Updating Content where scope, conditions, or activities change

12 Regulatory Duties

12.1

Health and safety and construction legislation imposes non-delegable duties on duty holders.

12.2

Nothing in the Platform or Service transfers, reduces, shares, or discharges those duties.

12.3

The User remains the sole duty holder in relation to all activities carried out using Content generated by the Platform.

13 Automated / AI-Assisted Outputs

13.1

Where the Platform uses automation, rules engines, or artificial intelligence, outputs are generated based on User input and predefined logic.

13.2

The Platform does not verify:

  • User-provided information
  • Automatically generated content
  • Methodologies, sequencing, or assumptions

13.3

Errors, omissions, or unsafe outputs may occur and must be identified and corrected by the User prior to use.

14 Incidents, Accidents, and Enforcement

14.1

In the event of any accident, incident, investigation, or enforcement action, use of the Platform must not be relied upon to attribute responsibility to the Platform or Service.

14.2

Responsibility for site safety and compliance cannot be transferred to a software provider.

15 Content Ownership

15.1

All Content created using the Platform remains the responsibility and property of the User.

15.2

The Platform claims no ownership of Content generated using the Service.

16 Exclusion of Liability

16.1

To the fullest extent permitted by law, the Platform accepts no liability for:

  • Injury, death, loss, or damage arising from site activities
  • Regulatory breaches or enforcement action
  • Errors, omissions, or deficiencies in Content
  • Reliance on Content generated using the Platform
  • Inaccurate qualification records entered into the Training Matrix
  • COSHH assessments used without verification against current Safety Data Sheets

16.2

The Service is provided on an "as is" and "as available" basis.

17 Limitation of Liability

17.1

Nothing in these Terms excludes liability for death or personal injury caused by negligence where such exclusion is unlawful.

17.2

Subject to clause 17.1, all liability arising out of or in connection with the Service is excluded to the maximum extent permitted by law.

18 Indemnity

18.1

The User agrees to fully indemnify and hold harmless Freddies Construction Solutions from all claims, liabilities, losses, damages, costs, and expenses arising from:

  • Use of the Service
  • Creation, publication, or reliance upon Content
  • Breach of Applicable Law
  • Injury, death, or property damage

19 Insurance

19.1

The Platform does not act as a safety consultant, designer, or contractor and does not hold insurance covering site safety decision-making.

19.2

The User remains responsible for maintaining appropriate insurance for their activities.

20 Third-Party Use and Distribution

20.1

Content must not be presented as having been approved, certified, or authored by the Platform.

20.2

Branding or references to the Platform do not imply responsibility for Content.

21 Account Suspension and Termination

21.1

The Platform reserves the right to suspend or terminate access where these Terms are breached.

21.2

Users may cease using the Platform at any time.

22 No Third-Party Reliance

22.1

No third party is entitled to rely upon any Content generated using the Platform.

22.2

The Platform accepts no duty of care to any third party.

23 Legislative References Disclaimer

23.1

Any references to legislation, regulations, Approved Codes of Practice, or guidance are indicative only.

23.2

Such references do not represent a complete or authoritative statement of legal requirements.

24 Export Confirmation

24.1

Prior to exporting, publishing, or sharing any Content, the User must confirm that the Content has been reviewed and approved by a competent person and is suitable and sufficient for the specific site and task.

24.2

Failure to undertake such review constitutes misuse of the Platform and a material breach of these Terms.

25 Entire Responsibility Acknowledgement

25.1

The Platform is a tool only. All responsibility for health and safety management, risk assessment, safe systems of work, worker qualification compliance, and COSHH management rests entirely with the User or other applicable duty holders.

26 Governing Law

26.1

These Terms are governed by the laws of England and Wales.

26.2

The courts of England and Wales have exclusive jurisdiction.
